RBG and the Open Supreme Court Seat

I thought it might be a good idea to have a RBG thread regarding the open supreme court seat and for some reason the thing I looked for a long time before was back again -- so -- new topic.

I'm mentally blocked right now -- I think a combination of the start of the school year and everything else.  When I try to focus in on this I get nothing -- not a sense of "nothing" like "nothing will happen and they'll wait to see who wins" I just can't see anything.  Have to wait until my wife goes to bed again to throw some cards.  Anyone have any senses on what happens to RBG's seat?  

Another interesting thing to look into would be a scan through 2021 -- if senators like Susan Collins continue to disappoint us, and we do in fact end up with a blue wave -- does Biden follow through on his "musing" from earlier in the year about adding two or four new justices to the court?

@dannyboy unfortunately I don’t have the energy to through cards on this today.  Before her passing, I kept seeing a big event was about to happen.  Later last night I was drawing the 8 of swords as the present situation, I got plenty of major Arcanas including the Sun.  Take this for what it’s worth.

I am so very sorry for her passing, for the great lost to your country and the world.  She fought all her life for what was right and to her dying breath she kept thinking of the country so so loved and served so honourably.

You have al my deepest sympathy

I'm going to weigh in here once, because I'm just exhausted.

I've seen this coming for a long time. RBG should have resigned in 2009, or at the latest 2014, but preferably before the Senate flipped red...

In any case, here's what the future holds as far as I can see:

It's not going to matter who is president. A fascist will be put in her place. If Twitler prevails (I say prevails because I don't think he'll win, nor do I think he'll leave), then the country is well and truly done. We will become an oligo-fascist-theocracy. Let's say Biden and/or Harris prevails. Let's say the Senate turns blue.

Count on this:  Congress passes progressive laws. Harris (or Biden) signs them into law. Some nutbar group sues in red state court to overturn. It gets kicked up to SCOTUS, who then backs up the nutbars and overturns every one of them. 

SCOTUS needs to be larger. It must be an odd number, and the number that I think would work as a minimum is 19. This would be up to Congress, requires a president to sign off, however does not require constitutional amendment.

There need to be term limits. In 1789, very few people lived to be over age 70. Now we typically see justices appointed at about age 50, making for at least a quarter century of time served. I think it should be limited to 12 years, and those years when terms end should never fall in a presidential election year. It should also be staggered to get the ball rolling. This would go a long way towards reducing the animus that occurs with every appointment from either side. This, however, would absolutely require constitutional amendment.

So on this issue, I am out of gas and out of hope.

She had many brushes where I thought "Oh god, this is the end" -- but she's been such an active and firm voice for so long I tended to brush aside the "She should have retired in..." thoughts from my brain.

I DO hope we can get through all of this without the civil war aspect though, and it doesn't seem to be a consistent prediction across the site thankfully -- My brain hasn't been able to fully grasp and process the events of 2020 to date, which is why I'm going to have a conversation with my doctor about options when my physical appointment comes up in November.  If it's having a hard time with this, I don't know where I'd end up mentally, emotionally, and physically if all out warfare were a prediction that came to pass.

I dont think there will be an actual civil war that breaks out, but with the right calling people to arms every Tuesday, it will definitely look like it for a while after the election

Whatever crap they try to pull, Dems will expand the court. I really think so. Ed Markey and Howard Dean have already said as much.

They stole Garland's seat, pushed through Kavanaugh-enough is enough. Past time to play hardball.

I think Dems need to stay quiet about stacking the court, at least publically. Ive given this a lot of thought today and realized a few things. 

If the nominee gets pushed thru, Republicans lose leverage they have over people who solely vote for court stacking. The urgency is gone for them and if they hate Trump bit would only vote to help the conservative courts, they won't vote if the SCOTUS seat is already filled. Its actually in the GOP best interest to say they'll wait, then try to rush it thru in the lame duck period. This way they keep those court only one issue voters. 

By pushing it thru, the Senate also loses a lot of never Trump conservative voters who have a sense of morality. This move very well can coat the GOP the Senate, which opens the door for huge changes with Blue in full power

Trying to find a gentle way to respond to anyone who talks about war here. I see

how frustrated and in pain you are and so you know not what you are saying.  So please accept some loving comfort and healing energy.   Do whatever it takes to get care.  Talk of war in any pro-war way is not okay.    It is suicidal thinking. I take it as a sign of being in need of care, and I do not take it as anything more.   It is also dangerous.   And please, if you hear people talking like that on Facebook or twitter, call then out.

@mas1581 I am 100% with you on this front.  

As of right now we have four Republican senators saying publicly they wouldn't vote to confirm until after the inauguration.  Collins, Murkowski, Grassley, and supposedly Romney.  I say supposedly because I looked them all up on twitter and I haven't seen Romney or Grassley, but places are starting to report it so it's somewhere.

As I thought on this more, I thought "maybe this is McConnell's way of trying to help some of his caucus in the election" because he doesn't usually say he's going to call for a vote unless he knows he has the votes behind him.  This allows some of his deep red state senators to go home and say they tried, "but that darn Romney..."

I don't know -- but it makes sense.

Jeanne - my response above to the post about war -- please feel free to delete that paragraph or the whole thing.  I was responding to a now removed post and trying to say what you ended up saying, in the worst way possible.

I found out RBG died yesterday just before our Zoom services for Rosh Hashanah began, so there were about 90 of us who found out at the same time and it was just devastating. 

It said that a person who dies on Rosh Hashanah or Shabbat (and yesterday was both) is considered blessed and a Tzadak - a righteous person. And she was. 

It's been one hit after another the past few weeks. I've tried to see something or anything about her replacement and I get nada. But then, the shock is still fresh, and so emotional.
