Got third shot yesterday from Walgreens, Fever this morning took Tylenol, much better. Slightly sore arm last night into this morning but now it's gone. Woohoo. The fever the day after always scares me though, since when I get a fever I get a high heart beat too and it makes me tired. After taking Tylenol my heartbeat dropped with the fever.

If a vaccinated  person gets a breakout covid case, could that person sue the one who gave it to him/her?

Just when one thinks it cannot get any crazier, there’s Breitbart ?

“In an article this month for Breitbart, the right-wing website formerly run by Steve Bannon, John Nolte argued that the partisan gap in vaccination rates was part of a liberal plot. Liberals like Biden, Nancy Pelosi, Anthony Fauci and Howard Stern have tried so hard to persuade people to get vaccinated, because they know that Republican voters will do the opposite of whatever they say, Nolte wrote.

His argument is certainly bizarre, given that Democratic politicians have been imploring all Americans to get vaccinated and many Republican politicians have not. But Nolte did offer a glimpse at a creeping political fear among some Republicans. ‘Right now, a countless number of Trump supporters believe they are owning the left by refusing to take a lifesaving vaccine,’ Nolte wrote. ‘In a country where elections are decided on razor-thin margins, does it not benefit one side if their opponents simply drop dead?’”

Interesting question. First the plaintiff has to be able to prove that they got sick from a specific person. Second, no vaccine is 100% effective, closer to 80-95%, depending on the person, the timing, and the particular vaccine. Third, there are some valid reasons for not getting vaccinated, including medical contraindications, ignorance, fear of the government, unavailability, and worry that the side effects will keep you out of work for a few days.  We are in the infancy stage of assigning liability.

It will probably come down to intent.  Did the unvaxed person know they were shedding covid and knowingly expose vulnerable people?

But I remember cases involved AIDS where the person knew they had the disease and still spread it to others.

One Canadian lawyer who is leading a $50 million class action suit against a long-term care facility where 71 patients died, said:  "'...if someone who intentionally forfeits vaccination “then knowingly goes out and makes absolutely no effort to protect others when they know, or ought to know, they have symptoms of COVID — they have a fever, a cough — those are the cases that might see the light of day in a courtroom,” said Barrie, Ontario lawyer Robert Durante. 'But again the wrongdoer would have to be someone who knowingly passed on the COVID.'”

It’s not always possible to prove the source of a COVID infection. “I think practically speaking it would be very difficult to prove. That alone would deter the vast majority of lawsuits,” Durante said. If there are no damages, as a matter of law there would be no point in suing. Most COVID infections are mild. If someone were to die, the family would be entitled to damages. “But I think the bigger issue would be people who develop symptoms of long COVID and can’t work,” Durante said.

“We’re really in the infancy stage right now, in terms of case law, and I think there will be lawsuits. And, frankly, I think it’s going to be very difficult for judges.”

Hi All, NSW is going to open up and live with Covid 19 it will be staged depending on vaccination rates but they envisage by 1st December there basically wont be any lockdowns.

The NSW government has revealed the freedoms people who are vaccinated against COVID-19, and those who are not, will get back before the end of the year.

Once 80 per cent of the eligible population is vaccinated — which is expected to happen sometime in October — those who have had two doses will be able to enjoy community sport again and have up to 10 guests visit their home among with a swathe of other freedoms.

But unvaccinated people will remain under stay-at-home orders until December 1.

By then, more than 90 per cent of people aged 16 and over are expected to be fully inoculated against the virus.

Some of the restrictions outlined below will come into effect on Monday, October 11 after the state reaches 70 per cent double-dose coverage, while others will be introduced when the state reaches 80 per cent later that month.

https://www.abc.net.au/news/2021-09-27/nsw-covid-19-roadmap-to-freedom-explained/100494028

Its still not clear on travel overseas but Qantas has scheduled international flights to recommence from mid-December 2021, offering bookings to destinations such as London and Los Angeles.

The national airline's online booking site is accepting bookings for Sydney and Melbourne to London flights on December 18, with flights also scheduled to Vancouver and Singapore on the same day.
On December 19 flights are also scheduled to Los Angeles, Tokyo, Hawaii and Fiji.

Will see what happens and when other states will do it too.

Hope it keeps under control, the idea being we live with it and we take precautions and hope it stays manageable for the hospital and health systems. Banking on people being sensible and not going nutty. Fingers crossed folks.

Regards to all.

Hi all, not feeling the love from Governor DeSantis here down under.  As an aside Florida and Australia have similar populations we are 25+ million I think Florida is about 22 million

https://www.news.com.au/world/coronavirus/australia/off-the-rails-florida-governor-ron-desantis-blasts-australias-covid-restrictions/news-story/9aea5a9f5df3c82cbf4bdcbdd62a8cd5

Off the rails’: Florida Governor Ron DeSantis blasts Australia’s Covid restrictions

One of the United States’ most prominent leaders has ripped into Australia’s coronavirus response, comparing us to “communist China”.

The leader of America’s third-largest state, Florida Governor Ron DeSantis, has blasted Australia’s coronavirus restrictions, accusing us of going “off the rails” and comparing us to authoritarian China.

Mr DeSantis, who has been a vocal opponent of lockdowns, mandates and vaccine passports in the United States, brought up Australia’s Covid policies during remarks to the International Boatbuilders Exhibition in Tampa.

Look what’s going on in Australia right now. They’re enforcing, after a year-and-a-half, lockdowns by the military,” the Republican said.

That’s not a free country. It’s not a free country at all.

In fact, I wonder why we would still have the same diplomatic relations when they’re doing that. Is Australia freer than communist China right now? I don’t know. The fact that is even a question tells you something has gone dramatically off the rails with some of this stuff.”

Mr DeSantis, widely seen as a leading contender for the Republican presidential nomination in 2024, boasted that Florida had led the way in opposing restrictions across the US.

For example, his state was among the first to ban private businesses from requiring proof of vaccination from their customers.

If we had not done that, a lot of these other states wouldn’t have followed,” he said.

Who knows where we would be right now?”

As it is, the US is not in a great place.

It’s currently in the midst of its fifth wave of Covid, exacerbated by the more infectious Delta variant. The country is averaging 115,000 new infections each day, and 1700 deaths.

To put that in context, the US is recording more deaths every 24 hours than Australia has suffered throughout the entire pandemic.

Florida is among the hardest-hit states. It has racked up a total of 3.6 million cases, and about 17,000 cases per 100,000 residents, placing it well above the national average.

Its death toll stands at 54,000, the fourth-highest in the US behind California, Texas and New York. On a per capita basis, it has the tenth-worst death rate.

Overall, the US has recorded 44 million infections and 711,000 deaths.

Meanwhile, Australia has recorded 101,000 cases and 1256 deaths.

Mr DeSantis has frequently sparred with the White House over his approach to Covid. Things got particularly bitter last month, when Florida broke its previous daily infection record.

Florida is a free state, and we will empower our people,” the Governor said in one fundraising email to his supporters in August.

We will not allow Joe Biden and his bureaucratic flunkies to come in and commandeer the rights and freedoms of Floridians.”

Meanwhile, White House Press Secretary Jen Psaki hit out at Mr DeSantis for taking “steps that are counter to public health recommendations”, such as banning schools from requiring their students to wear masks.

She urged him to “get out of the way” when it came to fighting Covid.

In response, Mr DeSantis told the President to focus on doing his own job.

Why don’t you do your job? Why don’t you get this border secure?” he asked, alluding to illegal immigrants arriving at the Mexican border.

Until you do that, I don’t want to hear a blip about Covid from you, thank you.”

Mr DeSantis’s public musings about America’s “diplomatic relations” with Australia come a week after Prime Minister Scott Morrison’s trip to the US, during which he addressed the UN, attended the Quad leaders’ summit and met with President Joe Biden.

During an appearance on the CBS show Face the Nation, Mr Morrison defended Australia’s Covid policies, including the strict international travel restrictions, saying they had saved tens of thousands of lives.

It’s around 1200 Australians (who) have lost their lives to Covid. That is what is lost in a day here in the United States,” he said.

If we had the same rate of fatality of just the OECD nations, on average, more than 30,000 Australians additionally would have passed away.

And so we took action to save lives. We also took action to save livelihoods. And our economy has come back strongly, even with the restrictions we have in place now.”

The Prime Minister said Australia and the US were “different societies”, and our response to Covid had been “pragmatic”.

I can tell you, the virus doesn’t care what you believe. The virus cares about how it can come and take your life,” Mr Morrison said.

Regards to all

@matildagirl   D-S started out his governership seeming more or less sane and reasonable, but he's totally lost it in the last year or so.

Ambition I guess, he wants to be President and he thinks this is what Trump followers want and what's a few dead bodies here and there. They are old, poor, a drain on the budget. Two birds with one stone, what's not to like.

Possibly I am maligning him and being a bit cynical.

Nope.  I agree with you that he is doing it for power--- but I also think it is backfiring on him.

Received my Pfizer booster today.  I had a Rite Aid appointment set and they called me right before I left for work to let me know that they didn't have any Pfizer in stock and didn't know when they would.  I got on our district health department website and found a 9:30 a.m. appointment for today so I took the day off (I already had the afternoon from my night class earlier in the week) and got er' done.

So far just like my first and second Pfizer shots I'm feeling not much - a slight fatigue (the only thing I really had with the second dose) but that could just as easily be my fall allergies which are in overdrive right now.  Either way I got my groceries for the week and am in the house and in my Pajamas until Monday morning.  Light and love all!

I am so happy for you!

You know, I feel like I did last spring. Celebrating each one of you as you report on getting your boosters.  I can't wait until I can get mine later this month.  I am looking forward to all the possibilities it provides. I embrace hope (and love, kindness, joy, compassion, light workers, gratitude and sound science).

@unk-p I have 3 former students working at this rite aid, two who were in my high school musicals.  They would have expected both the song AND the thong. ??

I will say my booster shot arrives on the news that an entire vein of my wife's extended family (unvaccinated, "Big Lie" believing, "Biden has Dementia" swearing, MAGA wardrobe owning) has tested positive for COVID-19 today.  My mother in law gives what we affectionately refer to as "the report" whenever anyone calls her but today she sent out a text thread to me, my wife, my brother in law and sister in law (both sets), to give the news.

I'm recognizing how terrible I am for making good on my promise from a few pages back in this text thread about not shedding or sparing any energy worrying about unvaccinated people in my life if they get it.  Losing the one friend this past summer in particular put me squarely in that position.  The best I can muster for them at this point, especially given how nasty they've been to us the last few years is a "Don't end up in the hospital".  I just don't understand how people can choose this particular hill to (potentially literally) die on.  I'd rather send that energy elsewhere.
