@snowbird

With the timeline, we are looking at, at quickest, the 8th for it to be invoked, he will delay his response for at least a day and then 4 days for Pence to reply so the 14th. Then the Senate is in recess now til the 20th so that pushes it out further. Even if Mitch calls them back for one last jab, it will take another day to get them back(the 15th) and then Cruz/Hawley will delay things as much as they can thru parliamentary procedure so maybe at best he is ousted the 18th or 19th. That gives him 10-11 days to retaliate to the 25th being invoked. If you think he is crazy now, just imagine what he will do if he knows he is going to be surely ousted in disgrace with no chance at refunding in 2024 or staying relevant.....and he has a week and a half to do it.

If those are my only 2 options, I'll take my chances with 12 more days of him trying to save his brand and stay relevant over 10 days with him being completely cornered even in his own mind.

? @mas1581, I'm not a lawyer, but it appears to me that once Pence and the Cabinet notify the Speaker of the House and the President Pro Tempore of the Senate that they have determined that T is not able to perform duty, Pence immediately becomes Acting President. Then T would have up to 4 days to dispute that. Then Congress would have up to 21 days to act. During the time that the issue is up in the air, Pence is Acting President. Voila. Biden is inaugurated before Congress is required to act.

How I read it, there would be a little bit of gray area since he isn't incapacitated(the motive for the law originally). With there still being so many Trump co-conspirators in the house, senate, and executive brach, it would get drug out as long as possible. Judiciary would end it but with appeals they would just have to wait it out a few days.

I believe @snowbird is correct based on this flowchart, written by a law professor and constitutional scholar.

We also have to consider that the majority of the cabinet would have to consent & do this in secret. The orange one wouldn't hesitate to fire someone willing to sign, thus making it difficult to get or keep the required number of signatures.

My biggest concern right now is that t***** will pardon all the insurrectionists who are in jail right now. CNN had pictures of the 4 most wanted from yesterday’s invasion of the Capitol Building and my first thought was that now that their names are out there, what will stop them from being pardoned for their actions by the criminal in the WH?

The charges will be a combination of district & federal. If they are smart, only district charges should be pressed in the next 2 weeks, and then federal after the 20th. Presidential pardons can't be applied to state, only federal. That's probably part of Mango's mania over staying in office. There's no telling if judges would uphold a self pardon-there's no prescedent yet, and he can't pardon himself of any state charges that may be filed.

I'm no lawyer. So maybe @allen could weigh in here.

@cindy That's immaterial.  As long as they hold the position at the time they sign the letter and it is transmitted to the appropriate Congressional authorities, it will be valid regardless.

You're right, there's no precedent because we have always had honorable people in office who knew that trying to do so was completely immoral and unethical.  ;-)  I have seen in several places where this has been discussed that if it were challenged, the SCOTUS would have to weigh in on it under the principle that no person can serve as both judge and jury at his/her own trial.

Glad to hear that. CNN earlier today was where that impression came from. I'm not sure if it's a case of needing to do better research, or the fact that since being written after JFK's shooting, the 25th has never been used, so the media consultants are each interpreting things from different perspectives.

They need to act on the 25th Amendment before he pardons himself. But I could see Mike Pence (as Acting President) dangling the offer of a pardon to T if he would simply leave and not fight a 25th Amendment process.

@snowbird  Perhaps, but would the Orange One believe him and/or trust him to follow through since in his mind Pence has already betrayed him by certifying the EC?

A Capitol Police office has died from injuries received yesterday.

Very sad.

Hoping the man who calls himself president  can somehow be held responsible for contributing to their death.

Look where unquestioned loyalty got Thomas Cromwell. Despots don't care.

Ooh!  Been reading the Wolf Hall books?  Me too. Political maneuvering techniques haven't changed much in 500 years, probably in millennia.

Since birth!

Love the shows, too. WH not as Hollywood entertaining as the Tudors version but much more historically accurate, both in fact and actor appearance.

@lovendures, Rachel Maddow just stated the earlier reports about the death of the Capitol Police officer were in error.  He is currently reported to be in critical condition.  I pray that he pulls through.

@journeywithme2. He should not be allowed to tweet or put out any messages again.  I'm sorry that Twitter can't get it right. That should have been permanent. Although  I feel everyone on earth is savable, he is too sick.

@journeywithme2, What the hell is wrong with Twitter?  I heard that they blocked him for 12 hours, which I thought was ridiculous and hoped they extended that.  If Facebook could close him down, Twitter certainly can.

@deetoo I think - but have no way to really know - based on the exactly two things he's tweeted beside that video, someone took control of his account and changed the passwords on him.  That's the only thing I can think of.  He's probably allowed to write anything he wants to tweet about on a piece of paper, but that's the extent of where 99% of those things go.

Or, I'll wake up tomorrow and he'll have started a "Free Sidney Powell" fundraising gig that direct deposits into one of his bank accounts.  I don't know. ??‍♂️
